General Policies & Waiver Agreement

Welcome to Sweat Studio. Our mission is to provide a safe, inclusive, and high-energy environment for your hot yoga and fitness journey. To ensure the best experience for all members, please review our consolidated policies below. By registering for any class, workshop, or session, you agree to be bound by these terms.

  1. WAIVER OF LIABILITY & RELEASE AGREEMENT

1.1 Assumption of Risk

I understand that yoga and fitness classes involve physical exertion that may be strenuous. I am fully aware of the risks and hazards associated with physical activity in a heated environment (Hot Yoga). I agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which I may incur as a result of participating in classes offered by Sweat Studio.

1.2 Medical Representation

I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation. It is my responsibility to consult with a physician prior to participation. I understand that yoga instruction is not a substitute for medical advice or treatment.

1.3 Limitation of Liability & Indemnity

To the fullest extent allowed by the laws of the Republic of Kenya, I hereby release Sweat Studio, its agents, employees, and directors from any responsibility or legal liability for injuries, damages, or death resulting from negligence or any other cause. I agree to defend and indemnify the Released Parties against any claims arising from my participation. This agreement is binding upon my heirs, family, and estate.

1.4 Media Release

I grant Sweat Studio permission to use photographs and videos taken during classes for marketing and promotional purposes. To opt-out, I must submit a request to the Studio in writing. Parental/Guardian consent is required for participants under 18.

  1. CLASS ATTENDANCE & BOOKING POLICIES

2.1 Cancellations & No-Shows

To maintain equitable access for all members, the following penalties apply:

  • Late Cancellation: Cancellations made fewer than six (6) hours prior to class start time will result in forfeiture of the class credit and an administrative fee of Kshs 500.
  • No-Show: Failure to attend without notice results in forfeiture of the credit and a Kshs 500 fee.

2.2 Tardiness & Late Arrival

  • Entry Cut-off: For safety and to prevent session disruption, clients arriving more than ten (10) minutes after the class has started will not be permitted to enter.
  • Forfeiture: Excluded late arrivals must rebook a new session and will forfeit the original class credit.

2.3 Private Sessions & Workshops

  • Private Sessions: Require at least 24 hours’ notice for cancellation. Late notice results in forfeiture of the session.
  • Workshops: Full payment is required upon enrollment and is non-refundable. If the Studio cancels a workshop (up to 7 days prior), a full refund will be issued.
  1. MEMBERSHIP & BILLING

3.1 Membership Cycles

  • Use-It-Or-Lose-It: Monthly class credits do not carry over to the next billing cycle.
  • Renewal: Billing recurs on the date of initial purchase.
  • Annual Commitments: Members are financially responsible for the full term. Cancellations after the term require written notice to sweathotyoga@sweatstudio.ke.

3.2 Tier Adjustments & Termination

  • Changes: Members may upgrade or downgrade tiers but must remain in the new tier for at least two (2) billing cycles. Grandfathered pricing is lost upon any change.
  • Early Termination: Termination of a committed membership requires payment of all remaining fees as per the signed contract.

3.3 Pregnancy Policy

  • Clearance: Pregnant clients must provide written medical clearance from a healthcare provider. The Studio reserves the right to limit participation if safety concerns arise.
  1. MEMBERSHIP FREEZE POLICY

4.1 Eligibility & Frequency

  • Applies to regular memberships only (excludes promotional/discounted rates).
  • Members may freeze their membership up to 3 times per calendar year at no extra cost.

4.2 Duration by Type

  • 1-Month Membership: Min 7 days / Max 20 days.
  • Quarterly Membership: Min 7 days / Max 45 days.
  • Annual Membership: Min 7 days / Max 90 days.

4.3 Medical & Pregnancy Freezes

  • Medical: With a doctor’s note, memberships can be frozen for up to 90 days (4 months in specific cases) at no charge.
  • Pregnancy: Qualifies for a medical freeze of up to 4 months upon medical advice to cease exercise.

4.4 Terms of Freeze

  • Written notice of 7 days is required.
  • No dues are collected during the freeze; studio access is suspended.
  • Prepaid memberships will have their expiry dates extended by the duration of the freeze.
  1. CODE OF CONDUCT & STUDIO ETIQUETTE

5.1 Zero-Tolerance Anti-Discrimination

Sweat Studio is a safe space. We maintain a zero-tolerance policy against harassment or discrimination based on race, religion, sex, gender identity, disability, or any other protected ground under the Constitution of Kenya. Violations will result in immediate termination of service without refund.

5.2 Studio Rules

  • Footwear: Street shoes are prohibited inside the practice area. Please use the entry mats.
  • Age Limit: Participants must be 18+, or accompanied by a legal guardian.
  • Early Departure: If you must leave early, please notify the instructor before class begins.
  • Refunds: All purchases are final. No refunds are issued for purchased passes or memberships.
